Since October 17, 2019 the production and sale of cannabis-infused products like edibles, cannabis extracts and cannabis topicals are legal under the Cannabis Act in Canada. Federally licensed cannabis sellers for medical purposes and provincial and territorial retailers are now allowed to produce and sell cannabis-infused products. By legalizing cannabis-infused products, Canada enters a new phase of its cannabis legalization.
Health Canada is officially declaring the sale of these products, including cannabis-infused beverages, baked goods, gummies, candies, lollipops and more. As of mid-September 2019, Health Canada is processing 150+ licensees in Canada, that allows the owner to possess, produce, sell and distribute plants, seeds and cannabis oil.
However, while infused products are technically legal, sales will not begin until mid-December because of the provision that requires processors to give regulators like Health Canada a 60-day notice to be able to release a new product for sale. These products are subject to strict regulations, to address their unique public health and safety risks. For comparison, as of September 2019, the top-selling edibles in California, Colorado and Nevada were gummies. Once the market matures in Canada, these cannabis-infused products are expected to be a multibillion-dollar market. According to Deloitte Canada, cookies, brownies, blondies and cereal bars, chocolates and gummies were reported as the most preferred cannabis-infused products with an expected market size of CA$1.6 billion.
